ToPAz Claims Management Pty Ltd (ToPAz, “we”, “our” and ‘us’) is concerned to protect  your privacy and confidentiality of the documents material and information (Data) we receive.

Our Policy sets out how we collect, use and disclose that material and our compliance with the Australian Privacy Principles (APPs) and the Privacy Act 1988 (Cth).

Pseudonymous interaction

You are not required to identify yourself in dealing with us but if you don’t it may alter how we deal with you and or the progress of your claim. In certain circumstances it may not be possible to dela with you win this way. But if you do provide your Data to us we will deal with it as follows:

Personal information

The Privacy Act defines ‘personal information’ as:

’Information or an opinion about an identified individual, or an individual who is reasonably identifiable:

  1. whether the information or opinion is true or not; and
  2. whether the information or opinion is recorded in a material form or not.’

It consists of

  • ‘sensitive information’ (includes information or opinion about an individual’s racial or ethnic origin, political opinion, religious beliefs, sexual orientation or criminal record, provided the information or opinion otherwise meets the definition of personal information)
  • ‘health information’ (which is also ‘sensitive information’)
  • ‘credit information’
  • ‘employee record’ information (subject to exemptions), and
  • ‘tax file number information’.

ToPAz collect the personal and sensitive information to manage a claims or undertake insurance recoveries from at fault individuals. Personal information as set out above is used by ToPAz to gather information about claimants or their representatives in accordance with our client’s instructions to investigate and manage claims or undertake insurance recoveries.

Who we collect Data from

We collect personal information (as defined above) about you and others directly from you or through others from:

  • Our clients – including insurers, cover holders, agents, brokers intermediaries, strata managers  as well as companies for whom we manage claims and customer complaints
  • Customers of our clients who submit claims or other parties
  • Our service providers – for example, investigators, process servers, solicitors, loss adjusters, medical and engineering experts, and other parties who we work with to resolve claims
  • Parties representing other parties including their solicitors .
  • Government bodies such the police, fire authorities and local councils – through FOI procedures

How we collect Data

We may collect personal information (as defined above) about you and others as follows:

  • over the phone,
  • digitally (email or our Portal), via public websites and public social media; and
  • in writing.

How we use collected Data

We use personal information (as defined above) to:

  • investigate, assess and manage claims
  • contact claimants and clients about any matters relating to a claim
  • report or obtain information from regulatory authorities (i.e. the Health Insurance Commission, Centrelink and other agencies)
  • prevent fraud
  • contact recovery targets for insurance recoveries which may include you
  • pursuant to an order form a court

ToPAz discloses personal information about you and others to other organisations when it is necessary to manage claims and undertake insurance recoveries. We provide this information to our clients, investigators, loss adjusters, solicitors and experts.

We may not be able to accede to your request and if so we will explain why.

ToPAz relies on you – what you must do

If you provide ToPAz with personal information (as defined above) about you and others, we trust that you have told them what we will do with it and obtained their consent.

If you have not done so you must tell us before you provide the personal information. If we provide you with personal information you must only use it for the purposes set out above. If you collect information you must do so in accordance with the privacy Act and the APP’s.

Security of your personal information

ToPAz will store your personal information only digitally. ToPAz ensures that personal information is secure and prevents misuse or unauthorised disclosure. All staff are required to employ two factor authentication when accessing our systems which are protected by Microsoft Azure and Microsoft Defender.
